AZW3 MetaData ToC broken on kindle and no cover

Hello everyone, thanks for being here.
from the FAQ I understand that the mobi file type is a bit of adrama queen and has issues with the cover and designation as doc or book, but it also inferred from these articles that the newer file type azw3 supposedly solves these.
I did try to convert a FB2 file to both mobi and azw3 and the results were disappointing for the azw3, the ToC (the metadata one for the go-to menu) didn't have all the segments.
there aren't many settings in the output options for the azw3 so I cannot really play around with anything and the "enable sharing of book content...." checked didn't make a difference.
I am wondering if anyone can help solve this conundrum.
