This is not Agatha Christie's works; this is one title and it is in the public domain in my country - the United States.
If it is not in the public domain in the country where one lives, then do not download it. Last edited by Dr. Drib; Yesterday at 10:19 AM. |

Hi folks,
A few facts before the discussion might heat up: ;-) Agatha Christie died in 1976. Posting Guidelines of mobileread.com, Section 8 (Links, Uploads, Copyright and DRM) Quote:
It's because the MR servers are located in the EU, where copyright extends to "life of the author plus 70 years after their death". https://en.wikipedia.org/wiki/List_o...s_of_countries So, Dr. Drib's argument might hold on other platforms where servers are not located in the EU and it's just the readers who have to watch the copyright laws of their respective countries, but in this case it's MR as the distributor of potentially still protected works and it therefore has to abide by EU laws by making use of the copyright guidelines quoted above. That's the facts as far as I can see (I am not a lawyer). Have a nice weekend everyone and long live MR! ![]() |

^ This. I thought the copyright issue had been thoroughly discussed and resolved years ago; I am a bit surprised that two eminent veterans of MR seem to be oblivious of the fact.

It doesn't make me happy to burst your bubble. It didn't make me happy when I couldn't include illustrations or dust jacket for Black Storm which I posted yesterday, because though the author died in 1949 and is perfectly eligible here, the artist didn't die until 1975 and his work will be under copyright in Europe for a while yet, even though both text and artwork for the title will be public domain in the USA on January 1, 2025. It is what it is. Sometimes, the different copyright periods for different countries are annoying as heck! But we gotta protect MobileRead from getting any flack over what we upload. |

Hello JSWOLF,
Quote:
That's a surprising reply given the facts and links mentioned above. Your assumption "It could be that the copyright was not renewed" presupposes an earlier expiration of copyright protection, which obviously is not the case for the works of Agatha Christie in the EU, because she died in 1976, and according to EU law, copyright extends to "life of the author plus 70 years after their death". MR servers are located in the EU, thus binding MR to EU copyright laws. So, as per MR's posting guidelines quoted above, in order to avoid any potential legal problems, works of Agatha Christie may not be posted on MR before the end of the year 2046 (1976+70), as far as I can see. Kind regards Thalassa Edit: I see graycyn has also replied while I was typing. ![]() @graycyn: You're making a good point hinting at the relevance of these laws also with regard to the date of death of artists / illustrators involved in the creation of these works, not just authors and translators. I don't exactly like it, since I have dustjackets for a few of my Hinkle titles and heaven knows, the hardcovers with original William Morrow dust jackets aren't common on the ground and ought to be preserved, but there it is. They can't be uploaded here. So I haunt Unsplash.com, Pixabay.com, and even Wikimedia Commons looking for suitable cover art. Some of the dust jackets, I can't even determine an artist name, and none is credited in the book, but I was told that if there was any reason to believe that it's possible the artist doesn't fall under life+70, I should not use them. Like I told Jon, it is what it is. MobileRead didn't make the copyright laws, they just have to follow them. |

@graycyn
Fully agree with every point you're making here. I have to admit it's got to be a real PITA for the creators here trying to adhere to these regulations, but, as you fittingly put it, "MobileRead didn't make the copyright laws, they just have to follow them." And we all don't want MR to get into legal troubles; I still remember the long time you couldn't access Project Gutenberg with a German IP address due to legal procedures. You and the other ebook creators here have my full respect, not just for all the efforts going into the process, but also for having to grapple with the legal stuff etc. ![]() Quote:

Reported this for the second time now. Since all the mods seem to be enjoying their weekend, please, Jon, take it down already. Prople have explained to you patiently why your upload may get MR into trouble—you don’t really want that, do you?
